VISITOR ACKNOWLEDGMENT OF RISK, RELEASE OF LIABILITY, AND AGREEMENT

1. Covered activities and property

In consideration for permission to enter property owned, leased, managed, or used by 4W Ranch (the Ranch) and to observe or participate in ranch, hunting, lodging, recreational, or related activities, I agree to this document. Covered activities include, as applicable, hunting, shooting, archery, wildlife viewing, hiking, riding in or operating vehicles or equipment, fishing, swimming, lodging, eating food, interacting with animals, and traveling to, from, or within the Ranch (Activities).

2. Acknowledgment of risks

I understand that the Activities and rural setting involve inherent and other risks that may cause property damage, illness, serious injury, disability, or death. Risks include:

· Uneven or unstable terrain; holes, rocks, brush, fences, tree stands, stairs, water, mud, and falls;

· Heat, cold, storms, lightning, flooding, fire, limited visibility, and other weather or natural conditions;

· Firearms, ammunition, bows, knives, tools, vehicles, ATVs/UTVs, trailers, machinery, equipment failure, and operator error;

· Wild, exotic, domestic, wounded, or unpredictable animals; insects, snakes, plants, and communicable diseases;

· Acts or omissions of participants, guides, guests, landowners, contractors, or other persons; and

· A remote location, delayed communications, and delayed access to emergency or medical services.

I have had the opportunity to ask questions. I voluntarily choose to enter the Ranch and participate, and I knowingly assume all risks, known or unknown, inherent or otherwise, to the fullest extent permitted by Texas law.

3. Texas agritourism warning

AGREEMENT AND WARNING: I UNDERSTAND AND ACKNOWLEDGE THAT AN AGRITOURISM ENTITY IS NOT LIABLE FOR ANY INJURY TO OR DEATH OF AN AGRITOURISM PARTICIPANT RESULTING FROM AGRITOURISM ACTIVITIES. I UNDERSTAND THAT I HAVE ACCEPTED ALL RISK OF INJURY, DEATH, PROPERTY DAMAGE, AND OTHER LOSS THAT MAY RESULT FROM AGRITOURISM ACTIVITIES.

4. Release of liability and covenant not to sue

TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I RELEASE, WAIVE, AND DISCHARGE 4W RANCH, THE PROPERTY OWNERS AND LESSEES, AND EACH OF THEIR MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, GUIDES, AGENTS, CONTRACTORS, VOLUNTEERS, AFFILIATES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, RELEASED PARTIES) FROM CLAIMS, DEMANDS, DAMAGES, OR CAUSES OF ACTION ARISING FROM MY ENTRY ON THE RANCH OR PARTICIPATION IN THE ACTIVITIES, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY. I COVENANT NOT TO SUE A RELEASED PARTY FOR A RELEASED CLAIM.

5. Responsibility for conduct, property, and compliance

I will follow Ranch rules and instructions; comply with hunting, firearm, wildlife, vehicle, alcohol, and other applicable laws; use equipment only when authorized and competent; and immediately report unsafe conditions, injuries, or property damage. I accept responsibility for loss or damage I cause through my conduct, subject to applicable law. The Ranch may stop my participation or require me to leave when it reasonably determines that safety, conduct, legal compliance, or property protection requires it.

6. Hunting financial responsibility

If I wound an animal and draw blood, as confirmed by the hunt guide or an authorized 4W Ranch representative, I agree to pay the full trophy fee established for that animal before the hunt, whether or not the animal is recovered or survives.  Any payments already credited toward that animal will be deducted from the amount owed.  Failure to recover the animal does not entitle me to a refund or a replacement animal.  The remaining balance is due before I depart the ranch.

7. Medical authorization

If I cannot provide informed consent during an emergency, I authorize the Ranch and responding personnel to seek or provide reasonably necessary first aid, rescue, transportation, and medical care. I understand that Ranch personnel may not be medical professionals and that emergency response may be delayed. I am responsible for resulting costs to the extent permitted by law.

8. Health and fitness

I represent that I am physically and mentally able to participate safely, will not participate while impaired, and will disclose to the appropriate Ranch representative any limitation that requires accommodation or may create a safety concern. I will stop participating if conditions exceed my ability or comfort.

9. Governing law; severability; entire agreement

Texas law governs this agreement. Venue will lie in Edwards County, Texas, unless applicable law requires otherwise. If a provision is held unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law. This document is the entire agreement concerning the matters it covers and may be modified only in a writing accepted by the parties.

10. Knowing and voluntary agreement

I HAVE READ THIS DOCUMENT, UNDERSTAND THAT IT AFFECTS IMPORTANT LEGAL RIGHTS, HAVE HAD THE OPPORTUNITY TO ASK QUESTIONS, AND SIGN IT KNOWINGLY AND VOLUNTARILY. I INTEND MY ELECTRONIC SIGNATURE TO HAVE THE SAME EFFECT AS MY HANDWRITTEN SIGNATURE.

11. Parent/guardian execution for a minor

If the Participant is under 18 years old then I represent that I am the minor's parent, legal guardian, or managing conservator and have authority to sign. I have read and agree to this document for myself and, to the extent permitted by Texas law, for the minor.

By submitting this form I confirm that I have read, understand, and voluntarily agree to the 4W Ranch Visitor Liability Waiver.
